Important information
Caution - SWATI cosmetic lenses are a quality product manufactured according to international safety standards (CE / FDA / ISO 13485) and in compliance with the European General Product Safety Directive (GPSD). To avoid irritation, inflammation or other serious effects to your eyes, please carefully read the supplied instructions. If you have not used contact lenses before, we recommend that you consult an optician or physician to ensure that the lenses are used correctly. These Contact lenses act to enhance or alter the colour of the eye for beauty and cosmetic purposes only. These lenses are intended for flexible wear (for use when awake and removed before going to sleep), 6-Months/Monthly/Daily replacement or as recommended by your optician or physician. They are not intended for use when asleep. If you do experience irritation or any other sign of allergy, immediately stop using the product.
General Information
These terms of use govern your purchases from, and your use of the SWATI website (https://www.swati.com/) and forms a contract between you and SWATI Group AB, Reg. no. 559092-3123, Kivra: 559092-3123, 106 31 Stockholm, Sweden. E-mail: support@swati.com, (hereinafter “SWATI”). By making a purchase from, and using, this website you have agreed to these terms of use. Please make sure that you have read and understood these terms of use when using our website.
Orders and Confirmation
When we receive your order we send a confirmation of your order together with these terms of use and an invoice to your e-mail address. It is therefore important that you enter your e-mail address correctly when placing an order. In order to provide you with the best possible customer care, and warranty information if needed, we advise you to use the same e-mail address in all contact with us. The order confirmation serves as a receipt and guarantee of proof of purchase. SWATI reserves the right to change its prices at any time, e.g. due to currency fluctuations. If a price is listed incorrectly, this may compel SWATI to cancel the purchase and refund any amount paid. This can be done at any time.
Payment & Merchant of Record
By completing your order SWATI.com you agree to purchase your item(s) from Global-e as merchant of record for the transaction, according to Global-e’s Terms & Conditions and Privacy Policy. Global-e is an international fulfilment service provider to SWATI. You may pay with the methods of payment that Global-E offers on the checkout page. SWATI does not in any case store any credit card numbers. When paying by a credit or debit card, the purchase is completed as soon as the card transaction is approved. In the event that no payment has been received after submitting your order or Global-E finds any fraudulent activity, SWATI may automatically cancel your order. All products remain SWATI’s property until full payment is received & verified.
Taxes
All prices shown on the SWATI website, www.swati.com, include VAT, in accordance with applicable legislation. Orders are shipped from Sweden. In case an order is shipped to a delivery address outside the EU, the VAT is deducted at the checkout or earlier depending on which country the product will be delivered to please note that you may be subject to import duties and taxes, which are collected when the shipment reaches your delivery address. In some countries, SWATI prepay/collects/subsidizes duties and taxes as per information shown on the Shipping and Delivery Policy. If your country is not mentioned you will be responsible for the payment of such import duties and taxes. It should also be noted that SWATI has no control over these charges and, since these charges are different for different countries, SWATI cannot predict their amount. SWATI advises you to contact your local customs office for more information.
Promo Codes
Enter Promo Codes during the checkout process for the code to be valid. It is not possible to add a promo code after a purchase is made.
Please Note: Free standard shipping* limits on purchases are based on value after applied discount or promo codes. In the event, standard shipping is not available in your region/country the equivalent value will be applied as a discount during the checkout process.
Clearance sale

No Refunds: Clearance items are not eligible for refunds, even if they are defective or damaged.

You have the right to request access to your personal data and you have a right to correct any personal data that is incorrect or incomplete. Products
Please note that the appearance when using the lenses may vary depending on your natural eye color. This is normal and the pictures depicting the products on the packaging and on the website should be viewed as references and illustrations of the product. The pictures may also differ depending on the color settings of your computer screen. We reserve the right for any errors that may appear on the page. SWATI reserves the right to change product information such as product pictures and offers without notice.
Prescription Verification
As a reseller of contact lenses, we are committed to ensuring that our customers receive products that are suitable for their eyes and meet their specific vision needs. To achieve this, the following terms apply:

Valid Prescription Requirement:
- Customers are required to have a valid prescription from a licensed eye care professional before purchasing contact lenses from our store. This prescription must include all necessary parameters to ensure the contact lenses are appropriate for the customer's eyes.

Prescription Verification:
- It is the customer's responsibility to ensure that the prescription provided is accurate, valid, and up-to-date. Prescriptions typically have an expiration date, and it is essential to renew expired prescriptions to continue purchasing contact lenses.
- We reserve the right to verify the prescription with the eye care professional who issued it. This verification process is conducted to ensure the safety and suitability of the lenses being ordered.

Right to Request Prescription:
- We may request a copy of the valid prescription before processing and shipping any order. Failure to provide a valid prescription upon request may result in the cancellation of the order.

Cancellation and Refund Policy:
- If we are unable to verify the prescription or if the prescription is found to be invalid or expired, we reserve the right to cancel the order.
In such cases, the customer will be eligible for a refund. The refund will be issued as a store credit equal to the amount of the cancelled order. This store credit can be used for future purchases once a valid prescription is provided. - By placing an order for contact lenses, you acknowledge and agree to these terms and understand the importance of having a valid, accurate, and up-to-date prescription for your eye health and safety.
- If we are unable to verify the prescription or if the prescription is found to be invalid or expired, we reserve the right to cancel the order.
APPLIES ONLY TO U.S. CUSTOMERS
We have implemented a prescription verification system that complies with US FCLCA (The Fairness to Contact Lens Consumers Act) and Rules which are currently applied to US customers only.
You can provide us with a valid copy (photo or scan) of your prescription, which you can upload via our HIPAA Compliant Form or Submit your Doctor's Name and Phone Number. Read more about our RX Verification here:
Delivery
SWATI ships worldwide. Deliveries are made in cooperation with the postal services and their partners. Prices and shipping costs will be displayed before you place an order on our website. You will also be informed of an estimated delivery time

Returns
You have the right to cancel purchases and return delivered goods by contacting SWATI’s customer service. The product must be unused, in its original packaging undamaged and with all the security seals intact. This is due to the importance of hygiene and to protect you as a customer. Products purchased directly from our website must be returned to us for a full refund to be made. SWATI reserves the right to determine the refund amount and mode depending on the charges incurred to fulfil the order. Products bought in a retail store shall not be returned to SWATI. Returned products shall be sent by the recommended letter or by the trackable package to ensure they arrive safely and unharmed. See our return policy for further instructions and where to send the products. Kindly note that you are responsible for any shipping expenses when returning the package to us. SWATI does not take responsibility for any items lost during the return shipping.
In cases where the order has been dispatched, the customer is required to receive the order. Cancellation is not valid until the customer has confirmed with SWATI by either e-mail or telephone. If a product has been discontinued SWATI has the right to cancel the purchase and refund the amount paid by the customer. SWATI will notify the customer of a replacement or equivalent product if available.
Complaints
It is important that you as a customer carefully check your products when you receive your shipment in order to verify that the products are not damaged and correct. If your product is damaged in transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your product and it is damaged or does not match the one you ordered, you shall also contact us within 30 days from receiving the product.
Any complaints shall be made to our customer service by e-mail using the address on the contact page. Please supply the order number and the reason for the complaint and we will get back to you shortly. The same applies to returns. Defective products returned to SWATI should be treated as if they were faultless. It is in all types of returns extremely important that the product be packaged in such a way that it cannot be damaged during transit. SWATI has the right to replace defective goods with goods of the same model. If the item has been discontinued, the customer will receive a full refund. In the case that a returned product has no errors or faults, SWATI will send the product back to the customer, but the customer is required to bear the shipping cost.
Warranty
SWATI’s products come with a one-year warranty from the date of purchase. This warranty covers only manufacturing defects on the lenses. In the case of receiving defective products, we will exchange them for free. They may only be exchanged for the same lens model and colour. To have replacement covered under this warranty performed, please use our contact form on the "contact us" page. In the e-mail, please specify your name, address, order number, and a detailed description of the issue. Write ‘defective product’ and your order number as the subject of the e-mail or letter. Return shipping is covered by SWATI if the product is defective. If SWATI cannot find any defects described above, the product will be sent back to the customer and the postage and handling charged to the customer.
Note that replacements will be charged to the customer in the following cases even when covered by warranty: (1) damage caused by improper use or carelessness, (2) damage caused by modification, (3) damage caused by fire or water, (4) esthetical changes that occur during normal wear and tear, (5) in case the retail store and date of purchase are not indicated on the warranty, or if this information has been rewritten, and (6) if the warranty is not submitted along with the product.
This warranty warrants that you can receive free replacement in accordance with the terms set forth herein and within the specified term, and shall not restrict any lawful right you may have under applicable laws depending on the jurisdiction.
Liability
SWATI’s responsibility for errors in connection to delivery is limited to existing conditions of sale. SWATI bears no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work, or other economic harm.
Force Majeure
SWATI shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered, or delayed by circumstances beyond our control. As the release factor should be considered include government intervention, new or amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions, or lack of delivery from suppliers and the company is exposed to criminal activity that affects activities.
Intellectual Property Rights
All intellectual property rights, such as trademarks and copyright, on the website and in the material published on it are owned by SWATI or its subsidiaries or licensors. Any use of the site or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of SWATI.
User Content
The www.swati.com website may include user-generated content, for example, social media applications. SWATI does not claim any ownership in rights in such content (images, photos etc.) and take no legal responsibility for it. In case you suspect a violation of copyright or any other right, or otherwise is offended by such content, please contact our customer service: support@swati.com.
Fraud
All frauds are reported to the authorities and SWATI reserves the right to cancel the purchase if any suspicion is raised.
Governing Law and Jurisdiction
These terms and your use of the www.swati.com website are governed by Swedish law. To the extent permitted by law, Swedish courts shall have exclusive jurisdiction of any dispute arising from these terms of use and your use of the website, subject to SWATI’s right to prosecute a user at his/her place of residence.
Termination
SWATI reserves the right to terminate your account and/or your use of the website www.swati.com at its sole discretion if SWATI, e.g. suspects that you have breached these terms of use. Such termination can be made without prior notice.
Amendments
SWATI may revise these terms at any time. When you order a product from us, the general conditions in force at that time will apply to the contract between you and SWATI. You should therefore review these terms to which you are bound when making a purchase.
Text Marketing Terms of Service
By consenting to SWATI Cosmetics’ SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list. Message frequency varies. Consent is not a condition of purchase.
If you wish to unsubscribe from receiving text marketing messages and notifications, use the unsubscribe link we provided you within any of our messages. You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out.
